Law360 Canada ( October 28, 2021, 6:11 AM EDT) -- Appeal by the plaintiffs, Wakeling and Evison, from an order striking privacy-related claims against the defendants, Desjardins General Insurance Group and their legal counsel, Constantino. In 2019, Evison challenged the defendant insurer’s decision to deny her accident benefits following an automobile collision. Wakeling, a close friend of Evison, attended a case conference as a witness on Evison’s behalf. Wakeling was also employed by the insurer and its predecessors for 24 years. When the insurer’s management learned of Wakeling’s participation in the case conference, they terminated her employment. Wakeling and Evison brought an action against the defendants alleging they invaded their privacy by revealing Wakeling’s participation to the insurer’s management. All the claims were struck save for Wakeling’s wrongful dismissal claim against the insurer. The action against the insurer’s legal counsel was dismissed in its entirety. The plaintiffs appealed....
