Law360 Canada ( August 1, 2018, 8:29 AM EDT) -- Action by Curley for damages for breach of contract and malicious prosecution. Curley was a law clerk and the defendant Taafe was a lawyer practicing primarily in the area of family law. Taafe also provided services in real estate planning. Curley approached Taafe in 2012 about referring real estate clients to Taafe. The parties signed a business agreement which provided, among other things, that Curley would refer clients exclusively to Taafe, and Taafe would provide legal services to Curley’s business for real estate, family law, wills, and provincial offences. The business agreement had a term of one year. Allegedly because Curley had not returned client files to her, Taafe contacted the police and Curley was charged with theft under $5000 and possession of stolen property. The charges were ultimately withdrawn by the Crown. Taafe again contacted the police, leading to further charges against Curley, including fraud under $5000 and forgery. Those charges were also withdrawn by the Crown....
