HEALTH CARE PROFESSIONALS - Professional misconduct - Unauthorized acts

Law360 Canada ( October 4, 2018, 8:58 AM EDT) -- Appeal by Zuk, a dentist, from the dismissal of his appeal from findings of unprofessional conduct by the Appeal Panel of the Alberta Dental Association. The Association began an investigation of Zuk’s conduct in 2008 relating to advertisements that claimed superiority and specialization he did not have, made time-limited offers, suggested the Association was corrupt, and were otherwise misleading about results that could be achieved by certain procedures. In 2015, the Hearing Tribunal of the Association found Zuk guilty of 21 allegations and imposed sanctions that included a one-year suspension of his registration and $175,000 in costs. The findings of unprofessional conduct related to Zuk’s advertising and his conduct in relation to the Association’s investigation process. The Tribunal found Zuk had breached an undertaking he signed in 2007 that he would make changes to his radio and internet advertising to comply with the Association’s Code of Ethics in his bus bench advertising. The Appeal Panel rejected Zuk’s argument that his statements were not advertising but rather opinion and belief and found the Hearing Tribunal’s decision was reasonable.
