The parties owned adjacent buildings that were attached to one another. Under the title deeds, the respondents, the Clarkes, had an easement over part of the appellants' property. The easement provided the respondents with interior access to the upper floors and roof of the respondents' property. A legal dispute arose due to the respondents' plan to adapt the property for mixed commercial and residential use. The appellants interfered with the right of way, arguing that the renovations impermissibly changed the use and size of the easement from access to storage space into use as an emergency exit. The application judge declared the easement valid and ordered the appellants not to interfere with the respondents' rights, including the right to make renovations, under the easement.
