Law360 Canada ( November 11, 2025, 9:33 AM EST) -- Appeal by British Columbia Environmental Appeal Board (Board) from judicial review of its decision. The District Director for Metro Vancouver (the District Director) issued a detailed environmental permit with a number of restrictions and requirements following an application by GFL to operate a large composting facility in Delta. GFL and several residents of Delta filed appeals with the Board. The Board ultimately allowed the appeals in part, ordering various changes to the permit. The District Director sought judicial review of the decision, alleging a reasonable apprehension of bias arose from the conduct of the panel that heard the appeal. The chambers judge agreed and quashed the decision and ordered costs against the Board. On appeal, the Board submitted that the decision had an impact on its ability to control its own process and to fulfill its statutory responsibility and sought clarity with respect to the way in which it undertook that responsibility.
