Counterclaim by the self-represented defendant for damages for defamation. The plaintiff alleged the parties, who were friends, orally agreed to establish a massage business as equal partners. The defendant testified that although the parties discussed a partnership, she operated the business as a sole proprietorship after the plaintiff failed to make a financial contribution to the business or agree to be jointly liable under the commercial lease. The plaintiff incorporated a company in both parties’ names without the defendant’s knowledge. The defendant had asked for his help to incorporate a company in her name only. Only the defendant’s name was on the business bank accounts and commercial lease. She alone paid the lease deposit from personal funds. The plaintiff lied in his affidavit to support substitutional service, filed a certificate of pending litigation against the defendant’s home, knowing she had not used business funds to purchase it, tried to place a builders’ lien on the defendant’s business premises knowing he had no legal basis for it, and altered court documents. He commenced the litigation after learning the defendant was dating his best friend.
