In a split decision elaborating on standard of review and other generally applicable administrative law principles, the Supreme Court of Canada has ruled that foreign nationals may appeal removal orders to the IRB’s Immigration Appeal Division if their visas were current on arrival in Canada, even if their visas expire post-arrival: Pepa v.
