Law360 Canada (November 29, 2021, 9:23 AM EST) -- Appeal by the City of Edmonton Library Board from a decision of the City of Edmonton Subdivision and Development Appeal Board (SDAB) that granted a development permit for a cannabis store to the respondent developer. The developer applied for a development permit to change the use of a general retail store to a cannabis retail store. The proposed store, located underground, was 110 metres from a public library, when the distance was measured site to site. The walking distance between the two sites was 400 metres. The SDAB granted the development permit by varying the 200-metre separation distance from a public library prescribed in the City of Edmonton Zoning Bylaw....
