Law360 Canada ( February 18, 2022, 6:16 AM EST) -- Application by Choquette for order extending the time within which to appeal the decision of the Chambers judge relating to administration of Joseph Viczko’s (“Viczko”) estate. Viczko had three children: Yvonne Choquette (“Choquette”), Donna Boots (“Boots) and David Viczko (“David”). Viczko’s will directed that he intended to sell his farmland and equally distribute the sale proceeds between Choquette and Boots. The will further provided that if, at his death, he had not sold the farmland, then it should be sold by his Trustee and the proceeds to be divided equally between his daughters. At the time of his death, Viczko had not sold the west half of the farmland. Boots was named as executor under the will. She sold the land to her brother, David. Choquette commenced an action seeking to set aside the sale and transfer on the grounds that the sale was not in good faith, and that her consent to the sale was required. The judge dismissed Choquette’s claim as she had withdrawn her allegation that the sale of the farmland was for less than fair market value and the judge ruled that Boots, as executor, had full discretion to determine the terms on which the land was sold....
