REVIEW BOARDS - Insanity or mental disorder - Not criminally responsible - Orders – Dispositions - Conditional discharge

Law360 Canada ( February 18, 2022, 6:18 AM EST) -- Appeal by Staetter from the disposition of the British Columbia Review Board (“Board”) maintaining his conditional discharge. Staetter was found not criminally responsible by reason of mental disorder for charges of uttering threats and criminal harassment. The index offences arose from Staetter’s deeply entrenched delusions of having a sexual relationship and having a son with a teenage girl, P.H. Staetter sent P.H. and her father many disturbing, violent and threatening voicemails and text messages, that deeply affected the victims. Denial of his psychiatric condition and his need for treatment combined with his persistent delusions that were resistant to treatment, led the Board to conclude that he continued to pose a risk to public safety. The Board made two attempts to reintegrate him into the community, but these failed as Staetter’s mental status deteriorated. The Board’s third attempt to reintroduce Staetter to living in the community was more successful so it granted Staetter a conditional discharge. However, he objected to the conditions and sought an absolute discharge before the Board one year later. He asked the Court to change the conditions and not require him to take any psychiatric drugs, to allow him to use marijuana as medicine and as part of his religion, and to allow him to go to his tattoo artist who resided in Whistler. ...
