Law360 Canada ( May 18, 2022, 6:22 AM EDT) -- Application by two electors and members of Red Pheasant First Nation contesting the validity of the 2020 Red Pheasant First Nation elections for Chief and Councillors. The applicants alleged the respondents, the successful Chief and eight Councillors in the Election, and others acting on their behalf contravened the First Nations Elections Act and First Nations Elections Regulations and engaged in electoral corruption, which contraventions included vote buying and forging Mail-In Ballots documents. The applicants sought to set aside the elections of the Chief and all eight elected Councillors. The central and principle issue was whether and to what extent any of the respondents were involved in vote buying. The vote buying almost entirely related to Mail-in Ballots.
