Law360 Canada ( August 25, 2022, 5:26 AM EDT) -- Appeal by the Police Services Board and Detective Magistrale from a judgment finding them liable to Hall for $686,217 in damages for false arrest, negligent investigation and malicious prosecution. Cross-appeal by Hall from the costs award of $275,000. A police investigation resulted in Hall’s arrest for attempted theft of a copper bar from a GM assembly plant. Hall, a contracted security guard for the plant, had been on duty at the time of the incident. He was terminated after his arrest. He was subsequently acquitted at trial. The trial judge found Magistrale failed to intervene to correct flawed evidence put to the judge during the criminal trial, deliberately lied in his characterization of a key witness at trial, and gave another Crown witness a “high five” outside the courtroom at the criminal trial....
