OFFENCES AND ENFORCEMENT - Commission orders for interim preservation of property - Review by Court

Law360 Canada (August 31, 2022, 5:45 AM EDT) -- Appeal by Dunn from a preservation order issued by the British Columbia Securities Commission. The Commission issued a notice of hearing to Dunn, alleging that Dunn breached an order of the Commission by acting as a director of two companies when he was prohibited from doing so. The Commission issued a preservation order on January 29, 2021. Dunn applied to the Commission to revoke the order, but that application was dismissed. Leave to appeal the preservation order was granted on September 29, 2021. Dunn took the position that the Commission exercised its discretion unreasonably in making the preservation order without any evidence of Dunn’s alleged wrongdoing and by considering the fact that a notice had been issued to be sufficient evidence of wrongdoing to justify the issuance of the preservation order....
