The analytical framework specific to seizures before judgment

On Dec. 15, 2021, the Quebec Court of Appeal, in Mercedes-Benz Financial Services Canada Corporation v. Seweha, 2021 QCCA 1893, stated that the analysis of the sufficiency of the allegations must be based on the allegations contained in the affidavit submitted in support of the seizure rather than on those contained in the statement of claim....
