Law360 Canada (September 23, 2022, 6:08 AM EDT) -- Appeal by beneficiaries from a chambers judge’s decision approving an estate’s sale of land. The executor of the estate advised that he intended to auction its farmland to the 12 beneficiaries and their spouses. He proposed that any beneficiary who bid would be deemed to have consented to the accepted offer, thereby dispensing with s. 50.5 of the Administration of Estates Act. The appellants, who were eight of the beneficiaries, expressed general agreement with the proposed sale process. The respondents, who were another beneficiary and his spouse, made the highest offer, which the estate accepted.
