Law360 Canada ( October 25, 2022, 10:06 AM EDT) -- Appeal by Doran Alfred Flock (Doran) from order severing joint tenancy in residential property held by Doran and his former spouse, Arlene Flock (Arlene), prior to Arlene’s death. When Doran and the late Arlene were married, they purchased a home in Calgary as joint tenants (Property). Later, they parted. Doran moved out of the property and left the payment of property related expenses to Arlene. William McKen (McKen), the litigation representative for and sole beneficiary of Arlene’s estate (Estate), lived with Arlene in the property in 1999. They married in 2009. McKen contributed to the mortgage, insurance, utilities, and maintenance of the Property. McKen continued to live in the Property following Arlene’s death, and to pay the mortgage until it was paid off in 2017. Doran filed a statement of claim against McKen alleging that McKen occupied the property without his consent and wrongfully enjoyed the exclusive use of the property without paying rent.
