Law360 Canada (October 27, 2022, 8:58 AM EDT) -- Motion by the Attorney General for the Northwest Territories seeking an order dismissing Raven Tours Ltd.'s (Raven) application for judicial review by reason of lack of jurisdiction. The Government of Northwest Territories created the Pandemic Relief Extension Program (PREP) to provide financial assistance to licensed tourism operators adversely affected by the COVID-19 pandemic. Tourism operators that had defaulted previously on a Government repayment plan or loan from the Business Development and Investment Corporation were ineligible for funding. Raven Tours Ltd. applied for funding but was unsuccessful. The reason cited for denying its application was based on it being a party related to another tourism operator which was in default of its financial obligations. Raven appealed the decision to the Assistant Deputy Minister of the Department of Industry, Tourism and Investment (ITI). The appeal was unsuccessful for the same reason as in the first instance.
