Law360 Canada ( November 15, 2022, 6:45 AM EST) -- Application by the respondent dog owners seeking to have the Originating Application struck on the basis that the Court of King’s Bench had no original jurisdiction to hear matters arising under the Dangerous Dogs Act (DDA). Three dogs owned by the respondents attacked and killed an elderly woman in the Capitol Hill neighbourhood in Calgary. The City of Calgary sought to declare the dogs dangerous and be humanely euthanized. The City submitted the Court of King’s Bench had inherent jurisdiction to hear matters under the DDA. The Respondents submitted that any proceeding under the DDA was a summary conviction proceeding for which the exclusive original jurisdiction lay with the Provincial Court or a Justice of the Peace....
