Law360 Canada (November 17, 2022, 6:23 AM EST) -- Claim by Kennedy in promissory estoppel and unjust enrichment against Marcotte’s estate and Propp. Kennedy wanted an order that would provide him with title to the farm. In the alternative, he sought financial compensation for the value of the portion of the farm to which he said he was equitably owed. In the further alternative, Kennedy asked for an award equal to the value of the farm labour he provided for the benefit of Marcotte. Marcotte lived alone in a modest house located on the farm. The Kennedy family and Marcotte had a close relationship for many years. Kennedy would help at the Marcotte farm on the weekends. The issue of how much time Kennedy spent working on Marcotte’s farm during the months he was not out fishing was disputed by the parties. Propp developed a friendship with Marcotte that was much closer than what might be expected to exist between ordinary neighbours. Marcotte’s will provided that Propp was the sole executor and trustee of Marcotte’s estate.
