The Appellant, Ben Luo, was a commission salesperson with Big Lobster Sea Food Inc. Wang contacted the Appellant to purchase some lobster. They ultimately agreed on the terms of a contract to ship approximately 1,000 pounds of live lobster to China in time for Chinese New Year that year. The lobster was not shipped, and the parties ended up having a dispute about why the lobster was not shipped. The Respondent began an action in the Small Claims Court in Toronto but later commenced an arbitration proceeding before CIETAC.
