By Heather MacIvor (March 13, 2023, 9:51 AM EDT) -- On March 6, a majority at the Ontario Court of Appeal struck down s. 37.10.1(2) of the Election Finances Act, R.S.O. 1990, c. E.7 for unjustifiably infringing the Charter (Working Families Coalition (Canada) Inc. v. Ontario (Attorney General), 2023 ONCA 139). It is extremely rare (if not unprecedented) for the same law to be nullified twice, for violating two distinct Charter guarantees. And that may not even be the most surprising part of the Court of Appeal decision....
