Law360 Canada (May 30, 2023, 6:02 AM EDT) -- Determination of whether the franchisees validly exercised the right to rescind and were entitled to statutory compensation. Three franchisees, Versatile Holdings Inc. (Versatile), Everest Group Inc. (Everest) and Premium Host Inc. (Franchisees), exercised the statutory remedy to rescind their franchise agreements pursuant to the Arthur Wishart Act (Franchise Disclosure) (Act) based on the alleged failure of the franchisor, Paramount Franchise Group Inc. (Paramount), to deliver a disclosure document that was not materially deficient. The evidence reflected that several disclosure documents were provided.
