The accused boarded the aircraft properly wearing a mask. He kept the mask on for a significant portion of the flight. Gomes, who was part of the air crew, was informed by other passengers that the accused had removed his mask. She approached the accused and asked him to reapply his mask. Initially, he ignored her and refused to comply with her request. Schaefer, another member of the air crew, approached the accused and asked him to reapply his mask. The accused stated that he suffered from asthma and anxiety. He testified that there was a serious medical emergency in the seat directly behind him. The accused said he soon began struggling to breathe. He later removed his mask to help himself recover. He said that he told one of the flight attendants he was having trouble breathing. However, he said that she dismissed his concern and insisted he put his mask on....
