Law360 Canada (December 1, 2023, 6:54 AM EST) -- Appeal by Sparks (Appellant) of Social Benefits Tribunal (“SBT”) decision finding Appellant not “person with disability” under Ontario Disability Support Program Act 1997 (ODSPA). The Appellant was diagnosed with ADHD at a young age and placed in special classes for reading and writing. The Appellant had difficulty focusing on a single task long enough to look for a job. The appellant would experience worthless feelings, “mental breakdowns”, and daily panic attacks, which caused him to sweat and self-isolate. The Appellant rarely left home because he was afraid of having a panic attack. The ODSP Director denied the Appellant’s application when he applied for income support, finding that he was not a “person with a disability” under ODSPA....
