SENTENCING - Weapons offences - Harassment and threatening - Forcible confinement

Law360 Canada ( August 30, 2024, 11:05 AM EDT) -- Appeal by JF from conviction for ten offences: assault with weapon, sexual assault, forcible confinement, and uttering death threats (all in relation to the second incident of violence), and four counts of careless storage of firearm. JF was charged with 14 offences alleged to have taken place in January 2018 while he was in an intimate relationship with the complainant. The charges arose out of two alleged episodes of violence against the complainant and a search of JF’s home pursuant to a warrant after his arrest on the initial charges. He received a 15-month custodial sentence and a concurrent three-month conditional sentence for the careless storage charges. JF appealed his convictions, arguing that the trial judge erred by presuming his guilt, placing undue reliance on the complainant's demeanour, relying on her lack of exaggeration to bolster credibility, and failing to provide sufficient reasons....
