CIVIL PROCEDURE - Judgments and orders - Enforcement - Stay of

Law360 Canada ( February 6, 2025, 10:03 AM EST) -- Motions by Amazon.com.ca ULC (Amazon), Apple Canada Inc (Apple), and Spotify AB (Spotify), collectively appellants, and Motion Picture Association-Canada, Crunchyroll, LLC, Netflix Services Canada ULC, Paramount Entertainment Canada ULC and Pluto Inc (“MPAC et al”) for stay of Canadian Radio-television and Telecommunications Commission (“CRTC”) orders. The CRTC issued a Broadcasting Regulatory Policy, CRTC 2024-121 (“June Policy”). It made some changes to the June Policy and released a revised version in August together with an order, CRTC 2024-121-1 which excluded the appended order (“August Policy”). The appellants each filed an application for judicial review and were also granted leave to appeal the August Policy and the related orders. Each of these appellants also brought a motion for a stay, in whole or in part, of the orders issued by the CRTC. Amazon and Apple each requested a stay of the payment requirements imposed by paragraphs 1 and 2 of the orders. Spotify requested a stay of the order. MPAC et al’s stay request was restricted to the requirement to contribute to the Independent Local News Fund (“ILNF”). The Attorney General of Canada (“AGC”) filed a single record responding to the motions for a stay brought by the appellants. The AGC did not dispute that there were serious issues to be tried.
