CONTROLLED DRUGS AND SUBSTANCES - Possession - Cannabis

Law360 Canada ( December 5, 2025, 9:47 AM EST) -- Appeal by Liu from conviction and sentence. Approximately five kilograms of cannabis and growing equipment were found in Liu’s car when he was stopped by police while driving from Calgary to Toronto. He was convicted of three offences contrary to the Cannabis Act: unlawfully possessing more than 30 grams of dried cannabis in a public place (possession count), possessing cannabis for the purpose of distribution, and possessing cannabis for the purpose of sale (distribution and sale counts). He was also convicted of possessing unstamped cannabis product contrary to section 158.11 of the Excise Act (Excise Act count). Under the Excise Act, the absence of a stamp indicated that applicable federal and provincial duties on the product had not been paid. Liu appealed from the convictions for the distribution and sale counts and the Excise Act count. He contended that the trial judge erred in admitting certain expert opinion evidence, which compromised his ability to make full answer and defence, and that the reasons for conviction on the Excise Act count were insufficient and linked to an error in law. Liu did not contest the conviction for the possession count but sought leave to appeal the sentence imposed in relation to that offence if the convictions were set aside on the distribution and sale counts....
