Law360 Canada ( January 8, 2026, 9:33 AM EST) -- Appeal by Nazeer from decision of a judge striking his statement of claim against several government officials (Government Defendants) and Ombudsman staff (Ombudsman Defendants). Nazeer alleged that the failure of his two businesses, one being a hotel in Theodore and the other a pizza restaurant in Foam Lake, was caused by the refusal of the Government Defendants to allow him to recruit foreign workers under the Saskatchewan Immigrant Nominee Program (SINP). He claimed that ambiguous rules and improper discretionary decisions led to repeated denials and the cancellation of his employer registration certificate. He also alleged that the Ombudsman Defendants conspired with the Government Defendants to destroy his businesses, citing delays in complaint evaluations and decisions. Nazeer sought $658,000 in damages for business losses and mental distress. The Defendants applied to strike the claim arguing it disclosed no reasonable cause of action, was scandalous and vexatious, and constituted an abuse of process. Nazeer’s claim was struck and the judge found that Nazeer failed to plead sufficient facts to establish causes of action. The judge found that while the claim adequately pleaded conspiracy and misfeasance in public office against some defendants, those claims were filed outside the two-year limitation period and were therefore barred. The judge also found that the conspiracy allegation based on shared ethnicity and friendship was scandalous and vexatious.
