(MTI) and Sierra Club Canada Foundation (Sierra Club) from judgment dismissing their application for judicial review of Minister of Environment and Climate Change’s (Minister’s) approval of Bay du Nord Development Project. Equinor Canada Ltd., holding a 65 per cent interest in an offshore oil development project located approximately 500 kilometres east of Newfoundland, proposed a project expected to produce approximately 300 million barrels of crude oil over 30 years. The Impact Assessment Agency of Canada (the Agency) conducted an environmental assessment and an integrated Crown consultation process with Indigenous groups. Following extensive review, consultation and reporting, the Agency concluded that the project was not likely to cause significant adverse environmental effects if mitigation measures and conditions were imposed. The Minister adopted the Agency’s findings, approved the project subject to extensive conditions, and concluded that Crown consultation obligations were fulfilled. MTI and Sierra Club challenged the decision, arguing that the Agency’s report was fundamentally deficient because it failed to consider marine shipping and downstream greenhouse gas emissions.
