Law360 Canada ( August 21, 2026, 9:48 AM EDT) -- Appeal by Tiny Township Association of Responsible STR Owners (appellants) and several individual property owners from dismissal of their application to quash Township of Tiny’s (Township’s) 2022 short-term rental (STR) bylaw. The Township enacted the bylaw following years of investigation, consultation and public input concerning complaints about STRs, including concerns about renter behaviour, housing availability and community impacts. The bylaw required STR operators to obtain annual licences, imposed operational restrictions, capped rental activity at 92 days per year, and limited the number of licences available. The appellants argued that the bylaw was ultra vires because it regulated non-commercial activity, effectively prohibited rather than regulated STRs, failed to account for existing property rights, and exceeded the Township’s authority by imposing a licence cap. They also sought leave to appeal a costs award of $38,000.
