(developer) from a decision of Calgary Subdivision and Development Appeal Board (SDAB) overturning a development permit issued by City of Calgary Development Authority (Development Authority). The development permit was for an eight-unit townhouse development in the R-CG (Residential – Grade-Oriented Infill) district in Bowness. The proposed development complied with all applicable Land Use Bylaw requirements for density, setbacks, height, parking and parcel coverage, and required no variances. The Development Authority approved the permit as a discretionary use. On appeal by neighbouring residents, the SDAB concluded that, despite compliance with the Bylaw, the development was “too far out of scale,” was incompatible with the character of the surrounding neighbourhood, and was unsupported by the Municipal Development Plan and the Bowness Area Redevelopment Plan.
