Law360 Canada ( September 16, 2026, 9:36 AM EDT) -- Appeal by Brillion Homes Ltd. (Brillion Homes) and Christa Vina Investment Ltd. (Christa Vina) (collectively, appellants) from a judgment awarding Tony Hayre Management Services Ltd. (Tony Hayre Management) damages for breach of a construction management contract. Brillion Homes entered into a written agreement retaining Tony Hayre Management to provide construction management services on a mixed commercial and residential development for a total contract price of $220,000 plus GST. The parties disputed the interpretation of the contract, including its duration and payment terms. The trial judge found that the contract required Tony Hayre Management to continue providing construction management services until the project was completed or the contract was terminated, awarded an outstanding amount of $40,000 plus GST, and additional monthly compensation for work performed in January and February 2020. The judge also held both Brillion Homes and Christa Vina liable. On appeal, the appellants argued that Christa Vina was not a party to the contract, that the judge implied a contractual term inconsistent with the express provisions of the agreement, and that the award for unjust enrichment was erroneous....
