Law360 Canada ( July 30, 2026, 2:54 PM EDT) -- Appeal by Democracy Watch from a decision of Federal Court of Appeal dismissing its application for judicial review. The Conflict of Interest and Ethics Commissioner (the Commissioner) released a report concluding that then-prime minister Justin Trudeau had not contravened the Conflict of Interest Act (the COIA) when he participated in two funding decisions relating to the WE Charity. Democracy Watch applied to the Federal Court of Appeal for judicial review of the Commissioner’s decision on the basis that the Commissioner committed errors of fact and law in interpreting and applying the COIA. The Attorney General of Canada argued that the application was barred by section 66 of the COIA, which purported to prohibit judicial review on questions of fact and law, and that political oversight under the statutory scheme constituted an adequate alternative remedy. The Federal Court of Appeal dismissed Democracy Watch’s application.
