DANGEROUS AND LONG-TERM OFFENDERS — Dangerous offender designation — Protection of the public

Law360 Canada (April 17, 2024, 2:22 PM EDT) -- Appeal by Jackman from convictions for criminal harassment, uttering threats, and attempted extortion and appeal from indeterminate sentence and designation as dangerous offender. Jackman engaged in a harassment campaign against his former common-law spouse, Jemetz, and her family. He had a fixed and false delusion that members of the Jemetz family were sexually abusing the five children that he and Jemetz had together. He sent hundreds if not thousands of electronic messages to members of the Jemetz family, threatening to kill them, rape their children, or attempting to extort money from them. He was arrested close to two homes occupied by members of the Jemetz family. After conviction following a judge-alone trial, Jackman raised, for the first time, a defense of not criminally responsible by reason of mental disorder (NCR). After a review of the psychiatric evidence, Jackman was designated a Dangerous Offender and sentenced to an indeterminate sentence. He appealed both his conviction and sentence, alleging that he should have been declared NCR, he should not have been designated a Dangerous Offender and he should not have received an indeterminate sentence....
