PHYSICAL AND PSYCHOLOGICAL INJURIES - Post-traumatic stress disorder (PTSD) - Mitigation

Law360 Canada ( August 10, 2018, 8:34 AM EDT) -- Action by the plaintiff for damages for injuries arising from a motor vehicle accident. The plaintiff’s tractor-trailer unit fell on its side following an impact with the defendant’s much smaller vehicle and slid down the highway. The plaintiff was 55. He suffered neck pain and headaches, both of which continued, and was diagnosed with post-traumatic stress disorder. The pain affected his sleep, previous activities, moods and ability to interact with others. He was a truck driver before the accident, but had difficulty finding steady employment after. He did not seek psychiatric treatment until three years after the accident. The trial occurred four years after the accident....
