WRONGFUL DISMISSAL - Dismissal without cause - Reasonable notice period or wages in lieu - Employee’s work record

Law360 Canada (November 11, 2022, 6:34 AM EST) -- Claim by Pasap that he was wrongfully dismissed by Saskatchewan Indian Gaming Authority Inc. (SIGA). Pasap was 47 years old. He earned a high school diploma. Pasap began his work life at 16. He continued to work on the pipeline as a labourer and welder’s assistant until he began work at the Casino. Pasap worked for the Casino on and off after it opened. He was continuously employed there for a period of close to five years. Pasap began at the Casino as a part-time general labourer, helping to construct the Casino building. Pasap became a full-time facilities supervisor. As Facilities Manager, Pasap was responsible for maintenance of the Casino building and grounds. In the role of Facilities Manager, Pasap supervised 15 employees. The nature of his work required evening, weekend and daytime work. During his career at SIGA, Pasap was never the subject of disciplinary measures. Pasap had been on a disability leave because of a back injury. SIGA claimed that Pasap’s work performance declined when he returned to work from his leave. Pasap was asked by Littlechief to come to his office. Littlechief gave him an ultimatum to resign, or he would be let go....
