The term “dependant” was defined in the Succession Law Reform Act (SLRA) and included an expanded definition of a child not only capturing the child of the deceased, but also included grandchild and, most relevant to this case, a person whom the deceased had demonstrated a settled intention to treat as a child of his or her family. The key issue for determination in this case was whether, on the limited evidence before this court, in the short period between July 2018 and April 2019, could a settled intention of the deceased to treat PCL as his child be found, making her a dependant to whom the deceased was either providing support or was under a legal obligation to provide support immediately before his death. The evidentiary record noted above was comprised of affidavits from the parties, family and friends and was replete with hearsay. There were no cross examinations on these affidavits....
