Law360 Canada (April 19, 2023, 6:27 AM EDT) -- Claim by Marnie Affleck for damages against Sunrise Senior Living, Inc., Sunrise of Mills, Seehra, and Garcia (Sunrise defendants). Affleck’s mother, Mrs. Stubley, was a resident at Sunrise of Mills. Linda Fraser, the plaintiff’s sister, held the powers of attorney for property and for personal care for Mrs. Stubley. She and Mr. Stubley were listed responsible parties for Mrs. Stubley at Sunrise of Mills. Ms. Fraser and Mr. Stubley became concerned that Affleck was abusing or attempting to abuse Mrs. Stubley, at least financially. They asked the Sunrise defendants to supervise Affleck’s visits with her mother. There were altercations between Affleck and Sunrise employees resulting in a Notice of Trespass that was given to Affleck. Police were called on multiple occasions. Affleck alleged that the Sunrise defendants took unreasonable steps to impede her ability to see her mother, and in so doing, caused her significant trauma and mental and physical injuries.
