Informal family property agreements after Anderson

Anderson 2023 SCC 13, the Supreme Court gave helpful guidance about the weight to be given to “informal” spousal agreements about family property. At the end of an unsuccessful reconciliation meeting, the Andersons had signed what we call “a kitchen-table agreement,” prepared by the wife and witnessed by two friends from their church. The agreement kept most of their assets and liabilities separate after their three-year marriage, except for the family home and the household goods....
