Law360 Canada (July 17, 2023, 9:15 AM EDT) -- Application by the claimant for sole conduct of sale of two properties. The properties involved the former family home and a warehouse owned by a family company in which the respondent’s own company previously operated a business. Although the parties recently accepted an offer to purchase the former family home pursuant to an existing order for joint conduct of sale, the claimant still wished to have sole conduct of that sale, to prevent the respondent from engaging in any actions that would thwart its completion. The issue was not whether either or both of the properties should be sold, but whether the parties were capable of cooperating to ensure that the sales that had already been ordered could be carried out....
