The Supreme Court of Canada has set out the framework for analyzing conviction appeals by accused who weren’t informed of their fundamental right to be tried in the official language of their choice (contrary to s. 530(3) of the Criminal Code) the first time they appeared before a judge, where no decision on their language rights was made at first instance: MORE TO COME.
