Law360 Canada ( September 11, 2026, 9:35 AM EDT) -- Appeal by appellant from decision of the Workers’ Compensation Appeals Tribunal (Tribunal) dismissing his appeal from decisions of the Workplace Health, Safety and Compensation Commission (Commission). The appellant injured his right wrist in a workplace accident in January 2023 and received benefits until October 2023, when the Commission determined that his injury was resolved and that he was able to work. The appellant later claimed that the workplace accident caused a permanent aggravation of a pre-existing arthritic condition in his right wrist and also caused compensable injuries to his left wrist and hand. The medical evidence included reports from Dr. Isa, who opined that the injury exacerbated or aggravated an underlying arthritic condition and likely accelerated its progression, MRI findings showing progressive degenerative changes consistent with chronic arthritis and no acute post-accident trauma, and a Canadian Health Solutions (CHS) multidisciplinary assessment concluding that there was no aggravation of the pre-existing condition and that any temporary exacerbation had resolved. The Commission submitted that the appellant’s ongoing symptoms reflected the natural progression of his pre-existing arthritis. The Tribunal found that there was conflicting evidence regarding aggravation or exacerbation of the pre-existing condition and regarding the claimed left wrist injury.
