TYPES OF DAMAGES - General damages - For personal injuries - Loss of earning capacity

Law360 Canada ( May 7, 2025, 1:30 PM EDT) -- Cross-appeal by Laurin from award for loss of future earning capacity. Laurin was injured in a motor vehicle accident in 2015 at age 27. Prior to the accident, she worked as a promotions director at A Channel and had plans to pursue a master’s degree. After the accident, she experienced ongoing headaches, cognitive effects, and was unable to work full-time in the same capacity. She eventually resigned from A Channel and took a part-time job at WorkBC. The respondents abandoned their appeal. The only issue on the cross-appeal concerned the award of damages for the loss of future earning capacity, which Laurin said should be significantly increased on the basis that the judge erred in misapprehending and disregarding the evidence of her expert economist and in his assessment of the award itself....
