Starting July 18, these new rules “will clarify existing procedures, simplify language and make the appeals process more efficient,” states a provincial government news release.
“These rules will help modernize the court system and improve access to justice for all British Columbians. Improvements also include new court forms that are more readable and include plain-language instructions.”
The new procedures include clarifying the requirements for applying for leave to appeal; updating filing requirements; outlining the case management process and laying out the orders that are able be made at the case management stage; and “simplifying ordinary costs to two scales and adjusting the tariff of costs.”
The changes are based on recommendations made during public consultations on proposed changes to the province’s Court of Appeal Act and Court of Appeal Rules conducted by staff from B.C.’s Ministry of the Attorney General in 2019 and 2021.
