N.W.T. proposes amendments to the Hours-of-Service regulations for electronic logging devices

Law360 Canada (March 14, 2023, 11:18 AM EDT) -- The government of the Northwest Territories (GNWT) is proposing “amendments to the Hours-of-Service regulations for electronic logging devices (ELDs) under the Motor Vehicles Act to support road safety in the Northwest Territories (NWT).”

According to a government release, issued March 13, the proposed amendments will “require the use of ELDs for commercial vehicles weighing at or above 4,500 kilograms operating in the NWT.”

“The amendments also propose providing an exemption to using ELDs for commercial vehicles weighing at or under 11,794 kilograms that are only driven in the NWT. Drivers of exempted vehicles would still need to log their hours of service but can do so in a paper log format,” the release explained.

ELDs, the release noted, “automatically record driving time in commercial vehicles.”

“The device replaces the paper log system and makes it easier to track, manage, share and improve the accuracy of a driver’s Hours-of-Service record,” the release added.

The amendments also “align the NWT with other jurisdictions in Canada that are working to implement this road safety measure,” the release explained, noting that the federal government has “mandated the use of ELDs, and all Canadian jurisdictions will implement and enforce this mandate in 2023.”

The GNWT is “targeting an enforcement date for the mandatory use of ELDs by the spring of 2023.”

The GNWT has issued a call for comment, so territory residents can “review and provide their feedback on the amendments to the Hours-of-Service regulations from March 13 to April 13.”
